Dear Ms. Rebecca H. Dietz,
Pursuant to the state open records law, La. Rev. Stat. Ann. Secs. 44:1 to 44:41, I write to request access to all documents, e-mails, faxes and other paperwork generated by the City or received by the City regarding the Cooperative Endeavor Agreement between the City of New Orleans and Louisiana Society for the Prevention of Cruelty to Animals. This should be from a period beginning January 1, 2014 through February 6, 2017.
This request should include but not be limited to all City Council member e-mails and cell phone transmissions.
I request access to any documents, e-mails, faxes and other paperwork to any City employee or representative from Anna Zorilla or any other board or staff member of the Louisiana Society for the Prevention of Cruelty to Animals.
If your agency does not maintain these public records, please let me know who does and include the proper custodian’s name and address.
I will come to City Hall, review each record and choose which records I will make copies of. If the cost would be greater than $50, please notify me and please also provide a receipt for the copies I choose to make.
As provided by the open records law, I will expect your response within three (3) business days. See La. Rev. Stat. Ann. Sec. 44.32(D).
If you choose to deny this request, please provide a written explanation for the denial including a reference to the specific statutory exemption(s) upon which you rely. Also, please provide all segregable portions of otherwise exempt material.
Please be advised that I am prepared to pursue whatever legal remedy necessary to obtain access to the requested records. I would note that a willful violation of the open records law can result in fines of up to $2,000 and imprisonment of up to six months, or both. See La. Rev. Stat. Ann. Sec. 44:37. Additionally, if a court finds your withholding of records to be unreasonable or arbitrary, it may award civil penalties of up to $100 per day, attorney fees and other costs of litigation, for which you can be held personally liable. See Sec. 44.35(E).
