All publicly releasable disciplinary records, personnel files, jacket(s), and internal investigation files for New Orleans Police Superintendent Michael Harrison.

I REQUEST A WAIVER OF ALL FEES IN MAKING THIS REQUEST.  Harrison is about to leave a police department under a consent decree to move to another department under a consent decree.  To see how he has performed as a police officer/commander/superintendent is of a strong public interest, considering the challenges he has faced in New Orleans, and will soon face in Baltimore.

We cannot fulfill your request. Louisiana Public Records Law exempts employee personnel records from disclosure.  The LA 5th Circuit held that public employees have a reasonable expectation of privacy in their personnel records and that expectation of privacy outweighs the benefits of disclosure of that information to the general public. See East Bank Consolidated Special Service Fire Protection District v. Crossen, 04-838 (La. App. 5th Cir. 12/28/2004), 892 So.2d. 666, writ denied, 897 So.2d 608 (La. 4/1/05)
